These Terms are in addition to our Site Agreement, which contains important definitions, disclaimers, and legal provisions that also apply to your use of the Platform. Welcome to YourVids. These Terms of Service constitute a legally binding agreement between you and YourVids governing your use of our Platform, including all features, services, content, and functionality we offer.

These Terms apply to:

• All visitors, users, and others who access or use the Platform.
• All content, features, and services available through the Platform.
• Any mobile applications, APIs, or related services we provide.
• All transactions, purchases, and financial activities conducted through the Platform.

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

In addition to the definitions provided in our Site Agreement, the following definitions apply to these Terms:

• "Custom Content" means personalized content created by a Creator at the specific request of a User.
• "Boutique" means the section of the Platform where Creators can sell physical or digital goods.
• "Bundle" means a collection of Content items sold together at a combined price.
• "Tip" means a voluntary monetary gift from a User to a Creator.
• "Wallet" or "Balance" means the virtual account balance associated with your Account.
• "Payout" means the transfer of Creator earnings from the Platform to their designated payment method.
• "Chargeback" means a reversal of a credit card transaction initiated by the cardholder or their bank.
• "Verified Creator" means a Creator who has completed our identity verification process.

3. Platform Description and Features

YourVids is an adult content platform that provides the following services and features:

For Viewers/Members

• Content Access: Browse, purchase, and view videos, images, and other digital content from verified Creators.
• Messaging: Connect with Creators through our secure messaging system.
• Custom Content Requests: Request personalized content from Creators who offer this service.
• Boutique Shopping: Purchase physical and digital goods from Creator stores.
• Tipping: Send voluntary tips to support your favorite Creators.
• Bundles: Purchase collections of content at bundled prices.

For Creators

• Content Monetization: Upload and sell videos, images, and digital content.
• Paid Messaging: Monetize direct communication with fans through paid messages.
• Custom Content: Create personalized content for individual buyers.
• Boutique Store: Sell physical merchandise and digital goods.
• Earnings Dashboard: Track sales, earnings, and analytics through Headquarters.
• Payout Services: Receive payments through various payout methods.
• Promotional Tools: Create bundles, promo codes, and urLinks.

We reserve the right to modify, add, or remove features at any time without prior notice. For Creator-specific terms, please refer to our Creator Agreement.

4. Account Registration and Eligibility

Registration Requirements

To access most features of the Platform, you must create an Account. During registration, you must:

• Provide a valid email address that you control.
• Create a secure password meeting our minimum security requirements.
• Choose a unique username that does not infringe on any trademarks or impersonate others.
• Confirm that you are at least 18 years old (or the age of majority in your jurisdiction).
• Agree to these Terms, our Site Agreement, and Privacy Policy.

Username Policy

Your username is your identity on the Platform. Usernames must not:

• Impersonate any person, brand, or entity.
• Contain profanity, slurs, or offensive language.
• Include contact information (email addresses, phone numbers, social media handles).
• Infringe on any trademark or intellectual property rights.
• Suggest affiliation with YourVids staff or official accounts.

We reserve the right to reclaim, reassign, or modify usernames at our sole discretion, particularly if they violate our policies or are inactive for extended periods.

Account Limitations

• Each individual may maintain only one Account unless expressly authorized.
• Accounts are non-transferable and may not be sold, traded, or given to others.
• Corporate or organizational accounts require prior written approval.
• We may require additional verification for accounts with unusual activity patterns.

5. Account Security and Responsibilities

You are solely responsible for all activities that occur under your Account. You agree to:

• Keep your login credentials confidential and secure.
• Use a strong, unique password not used for other services.
• Regularly review your account activity and transaction history.
• Log out from shared or public devices after each session.
• Notify us immediately at support@yourvids.com if you suspect unauthorized access.
• Regularly review your account activity and transaction history.

You acknowledge and agree that:

• YourVids is not responsible for any loss or damage resulting from unauthorized use of your Account.
• You may be held liable for losses incurred by YourVids or others due to unauthorized Account access resulting from your negligence.
• We may require additional verification before processing certain transactions or changes to your Account.

6. Payment Terms and Billing

Accepted Payment Methods

We accept the following payment methods:

• Major credit and debit cards (Visa, Mastercard, Discover)
• Other payment methods as may be made available from time to time

All payments are processed through our third-party payment processors. By making a purchase, you agree to the terms and conditions of our payment processors in addition to these Terms.

Pricing and Currency

• All prices are displayed in U.S. Dollars (USD) unless otherwise specified.
• Prices are set by Creators for their content and may vary.
• Platform fees and minimum prices may apply to certain transactions.
• Prices are subject to change without prior notice.
• Currency conversion fees may apply for international transactions.

Taxes

You are responsible for paying all applicable taxes associated with your purchases. Depending on your location, prices may or may not include applicable taxes. We may be required to collect and remit sales tax, VAT, or other taxes in certain jurisdictions.

Billing Descriptor

For your privacy, charges from YourVids will appear on your billing statement with a discreet descriptor. The exact descriptor may vary by payment method. If you have questions about a charge, contact support@yourvids.com.

Authorization

By providing payment information and completing a purchase, you authorize us to charge the specified amount to your payment method. You represent and warrant that you have the legal right to use any payment method you provide.

7. Refunds and Chargebacks

Due to the nature of digital content, all sales are generally final. For complete information about our refund policies, please see our Refund Policy.

Chargeback Policy

Chargebacks harm our Creators and the Platform. If you initiate a chargeback:

• Your Account may be immediately suspended pending investigation.
• We will dispute the chargeback and provide evidence of the transaction.
• If the chargeback is determined to be fraudulent, your Account will be permanently terminated.
• You may be liable for any fees or damages resulting from the chargeback.
• We reserve the right to pursue legal action for fraudulent chargebacks.

We strongly encourage you to contact us before initiating a chargeback. We are committed to resolving disputes fairly and promptly.

8. Content Access and Restrictions

Purchased Content

When you purchase content on YourVids:

• You receive a limited, non-exclusive, non-transferable license to view the content for personal, non-commercial use.
• Purchased content is accessible through your Account library.
• Access continues as long as the content remains on the Platform and your Account is in good standing.
• We cannot guarantee indefinite availability if the Creator removes the content or closes their account.

Restrictions on Content Use

You may NOT:

• Download, copy, reproduce, distribute, or share purchased content except where expressly permitted.
• Screen capture, record, or otherwise capture streaming content.
• Resell, sublicense, or commercially exploit any content.
• Remove, alter, or obscure any watermarks, copyright notices, or other proprietary markings.
• Use any content in a manner that violates the Creator's rights or these Terms.
• Share your Account or purchased content with others.

Content Availability

Content availability is subject to:

• Creator decisions to remove or modify their content.
• Platform moderation and policy enforcement.
• Legal requirements and takedown requests.
• Technical limitations or changes to the Platform.

We do not guarantee that any specific content will remain available indefinitely.

9. Content Submission and Licensing

If you submit, upload, or post any content to the Platform (including comments, messages, profile information, or Creator content), you:

Grant of License

Grant YourVids a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with:

• Operating and providing the Platform and its features.
• Promoting and marketing the Platform.
• Developing and improving the Platform and related services.
• Any other purpose related to the Platform's operation.

Your Representations

By submitting content, you represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to the content.
• You have obtained consent from all individuals appearing in the content.
• The content does not infringe on any third-party rights.
• The content complies with all applicable laws and our content policies.
• You are solely responsible for your content and any consequences of posting it.

10. Prohibited Content

The following content is strictly prohibited on YourVids. Violation will result in immediate content removal, account suspension or termination, and may be reported to law enforcement:

Absolutely Prohibited (Zero Tolerance)

• Minor-Related Content: Any depiction, suggestion, or implication of anyone under 18 years of age in any context whatsoever, including animated, virtual, or AI-generated content.
• Non-Consensual Content: Any content depicting non-consensual acts, including sexual assault, rape, "revenge porn," or content posted without the depicted individual's consent.
• Trafficking/Exploitation: Any content related to human trafficking, sexual exploitation, forced labor, or slavery.

Prohibited Content Categories

• Violence and Gore: Extreme violence, blood, gore, torture, mutilation, or death.
• Animal Content: Animals in any sexual, violent, or exploitative context.
• Illegal Activities: Drug use or trafficking, weapons, terrorism, or other illegal activities.
• Hate Content: Content promoting hatred, discrimination, or violence against individuals or groups based on protected characteristics.
• Incest: Real or simulated incest or content depicting family members in sexual situations.
• Bodily Waste: Certain content involving bodily waste that violates payment processor policies.
• Extreme Content: Content depicting extreme acts that may violate payment processor requirements.

Other Prohibited Content

• Content that violates any applicable law or regulation.
• Content that infringes on intellectual property rights.
• Fraudulent, misleading, or deceptive content.
• Spam, malware, or content designed to harm users or systems.
• Content that violates payment processor policies.

11. Prohibited Conduct

The following conduct is prohibited on the Platform:

Harassment and Abuse

• Harassing, threatening, stalking, or intimidating any user.
• Sending unwanted sexual messages or requests after being told to stop.
• Doxxing or sharing private information without consent.
• Bullying, name-calling, or targeted attacks.
• Inciting others to harass or harm anyone.

Fraud and Deception

• Impersonating any person or entity.
• Using false information to create an account or verify identity.
• Engaging in payment fraud, including unauthorized use of payment methods.
• Manipulating reviews, ratings, or engagement metrics.
• Engaging in money laundering or other financial crimes.
• Filing false DMCA claims or abuse reports.

Platform Abuse

• Creating multiple accounts without authorization.
• Sharing account credentials or allowing others to access your account.
• Using bots, scripts, or automated tools to interact with the Platform.
• Scraping, harvesting, or collecting user data.
• Attempting to circumvent security measures or access restricted areas.
• Interfering with the Platform's operation or other users' access.
• Promoting competing platforms or soliciting users to move off-platform.

Commercial Violations

• Conducting transactions outside the Platform to avoid fees.
• Soliciting direct payments or sharing payment information.
• Using the Platform for unauthorized commercial purposes.
• Selling counterfeit or unauthorized merchandise.

12. Intellectual Property

Platform Intellectual Property

The Platform, including its design, features, software, and all Platform Content, is owned by YourVids and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our written permission.

User Content Ownership

Creators retain ownership of their original content. However, by uploading content to the Platform, Creators grant YourVids certain licenses as described in the Creator Agreement.

Copyright Infringement

We respect the intellectual property rights of others and expect our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices. For complete information about our DMCA procedures, see our Content Removal Policy & DMCA.

Repeat Infringer Policy

We maintain a repeat infringer policy. Users who repeatedly infringe copyrights will have their accounts terminated. See our Content Removal Policy & DMCA for details.

13. Privacy and Data

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Platform, you consent to our collection, use, and sharing of your information as described in our Privacy Policy. You also acknowledge that:

• We may collect and process your personal data to provide our services.
• We may share data with third-party service providers as described in our Privacy Policy.
• We may be required to disclose your information in response to legal requests.
• You have certain rights regarding your personal data as described in our Privacy Policy.

14. Third-Party Services

The Platform may integrate with or link to third-party services, including:

• Payment processors for transaction processing.
• Identity verification providers for creator verification.
• Content delivery networks for media streaming.
• Analytics services for platform improvement.
• Social media platforms for authentication or sharing.

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services. We encourage you to review their terms before using them.

15. Termination and Suspension

Termination by You

You may close your Account at any time by:

• Going to your Account settings and selecting "Close Account."
• Contacting support at support@yourvids.com.

Upon account closure:

• You will lose access to all purchased content and features.
• Any remaining paid access periods will not be refunded.
• Creators will receive their pending payouts subject to our standard payout policies.

Termination or Suspension by Us

We may suspend or terminate your Account immediately, without prior notice or liability, for any reason, including if:

• You violate these Terms, our policies, or any applicable law.
• You engage in fraudulent or abusive conduct.
• We receive a valid legal request requiring account suspension.
• Your account poses a security risk to the Platform or other users.
• You fail to complete required verification processes.
• Your account has been inactive for an extended period.

Effect of Termination

Upon termination:

• Your right to access the Platform immediately ceases.
• You remain liable for any outstanding obligations.
• We may retain certain data as required by law or for legitimate business purposes.
• Provisions that by their nature should survive termination will remain in effect.

User-to-User Disputes

Disputes between users (e.g., between a Creator and a buyer) should first be resolved directly between the parties. If you cannot resolve a dispute directly:

• We may, but are not obligated to, mediate disputes at our discretion.
• Our decisions in any mediation are not binding on either party unless otherwise agreed.

YourVids is not a party to and is not liable for any disputes between users.

17. Modifications to Terms

We may modify these Terms at any time at our sole discretion. When we make changes:

• We will update the "Last Updated" date at the top of these Terms.
• For material changes, we will provide notice through the Platform, by email, or by other appropriate means.
• We will provide at least 30 days' notice before material changes take effect, except where required by law or for urgent security matters.

Your continued use of the Platform after changes take effect constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your Account.

18. Survival

The following provisions shall survive termination or expiration of these Terms:

• All definitions and interpretation provisions.
• All intellectual property provisions.
• All disclaimers, limitations of liability, and indemnification provisions.
• All dispute resolution and arbitration provisions.
• All provisions related to payment obligations and outstanding balances.
• Any other provisions that by their nature should survive.

19. General Provisions

Entire Agreement

These Terms, together with our Site Agreement, Privacy Policy, Creator Agreement (if applicable), and all other policies referenced herein, constitute the entire agreement between you and YourVids.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign or transfer these Terms without restriction.

Identity Verification

Before you can upload content, you must complete our identity verification process. This involves:

• Submitting a valid government-issued photo ID through our secure verification partner
• Completing a live selfie check to confirm your identity
• Registering your face for our content verification system

Maintaining Your Account

License to YourVids

You Must Appear in Your Content

Co-Creators

If other people appear in your content, they must be:

Content featuring certain themes, even in titles or descriptions, may be flagged and removed regardless of the actual visual content. This includes references to blood, certain bodily fluids, and extreme scenarios. Our moderation system automatically flags these for review.

7. Boutique & Store Items

Physical Items

If you sell physical items through your Boutique:

• Items must be legal to sell in your jurisdiction and the buyer's jurisdiction
• You are responsible for packaging, shipping, and delivery
• Product descriptions must be accurate
• You handle any returns or disputes directly with buyers
• Prohibited items include weapons, drugs, counterfeit goods, and hazardous materials

Digital Goods

Digital items (photo sets, video bundles, etc.) must meet the same content standards as regular uploads. All content policies apply.

Item Images

Boutique item images go through our moderation system. Images must accurately represent the item and comply with our content policies.

8. Custom Content

Accepting Requests

You control your custom content settings, including whether you accept requests, your pricing, and delivery timeframes. When you accept a custom request, you're committing to deliver the content as described within the agreed timeframe.

Your Boundaries

You always have the right to decline any custom request for any reason. Set clear boundaries in your profile about what you will and won't do. Never feel pressured to accept requests that make you uncomfortable.

Delivery & Disputes

Deliver custom content within your stated timeframe. If you cannot deliver, communicate with the buyer promptly. Undelivered customs may be refunded, which affects your earnings. All content policies apply to custom content.

9. Pricing & Fees

You Set Your Prices — You Keep 100%

You have full control over pricing your content within our platform guidelines. Set prices that reflect the value of your work and what your audience is willing to pay. The price you set is the exact amount you receive — no deductions, no cuts, no hidden fees.

Platform Fee — Paid by Fans, Not Creators

YourVids operates on a unique model where the platform fee is paid by the fan, not taken from your earnings. When a fan purchases your content, the platform fee is added to their total at checkout. You receive 100% of your listed price.

The fan-paid platform fee covers payment processing, platform hosting, moderation, support, and all the infrastructure that keeps YourVids running. This model ensures creators keep every dollar they earn.

Tips

Tips from viewers work the same way — you keep 100% of the tip amount. The platform fee is paid by the fan on top of their tip. Tips are voluntary contributions from your audience and are processed through our standard payment system.

10. Earnings & Payouts

Tracking Your Earnings

Monitor your earnings in real-time through your Headquarters dashboard. You can see sales, tips, pending amounts, and payout history.

Hold Period

Earnings are held for 7 days before becoming available for payout. This hold period protects against chargebacks and fraud. After 7 days, your earnings become "ready for payout."

Minimum Payout

You must reach a minimum balance before requesting a payout. The default minimum is $50, but you can adjust this to $200, $500, or $1,000 in your settings. Higher minimums mean fewer transaction fees for you.

Payout Methods

We currently offer the following payout option:

Additional payout methods including Paxum, Cosmopay, Cryptocurrency, and ACH Bank Transfer will be available in the future. We will notify you when new options become available.

Choose your preferred method in Settings. Once set, your payout method is locked for security reasons—contact support if you need to change it.

Chargebacks & Refunds

If a buyer disputes a charge or requests a refund, the amount may be deducted from your earnings. We investigate all disputes and only process legitimate claims. Creators with high chargeback rates may have payouts delayed or accounts reviewed.

11. Your Responsibilities

Tax Obligations

You are an independent creator, not an employee of YourVids. You are solely responsible for:

• Reporting all income to relevant tax authorities
• Paying applicable income taxes, self-employment taxes, and any other taxes
• Understanding your local tax obligations
• Providing any tax documentation we require (such as W-9 for US creators)

We may be required to report your earnings to tax authorities. Consult a tax professional for advice specific to your situation.

Record Keeping

Maintain records of:

• Age and identity verification for yourself and all co-creators
• Consent documentation for everyone who appears in your content
• Any releases or permissions for music, images, or other media
• Your earnings and expenses for tax purposes

These records must be kept for the duration required by applicable law and made available upon request.

Legal Compliance

You are responsible for complying with all applicable laws in your jurisdiction, including but not limited to age verification requirements, record-keeping obligations, and any licensing or permits required for your activities.

12. Account Standing

Warnings

Minor policy violations may result in warnings. We'll explain what went wrong and what to do differently. Repeated warnings escalate to more serious consequences.

Content Removal

Suspension

Serious or repeated violations may result in temporary suspension. During suspension, you cannot upload new content or access certain features, but your existing content may remain visible. Suspended earnings are held until the matter is resolved.

Termination

Severe violations or patterns of abuse result in permanent account termination. This includes immediate removal of all content, forfeiture of pending earnings below the minimum threshold, and permanent ban from the platform.

13. Termination

Closing Your Account

You can close your creator account at any time through your Settings or by contacting support. When you close your account:

• Your content will be removed from the platform
• Pending earnings above the minimum threshold will be paid out on the next payout cycle
• Earnings below the minimum threshold may be forfeited
• Your username may become available for others after a waiting period

Our Right to Terminate

We reserve the right to terminate your account for violations of this Agreement, illegal activity, fraud, or any conduct we deem harmful to the platform or its users.

After Termination

YourVids may be considered a secondary producer for certain content hosted on our Platform.
